- Eligibility to subscribe
1.1You meet the qualification criteria if you ‘the customer’ are a school participating in any Wastebuster programme.
2.1These terms and conditions govern your use of the Wastebuster website and all resources as stated in the related service brochure; by agreeing and checking the box, you accept these terms and conditions in full.2.2Wastebuster reserves the right to change these terms and conditions at any time and will make you aware of any changes via the contact email provided.2.3If specific terms appear in other areas of the site relating to specific material or use, then they will prevail over these general Terms and Conditions.
- Intellectual property rights
3.1Unless otherwise stated, Wastebuster own all intellectual property rights in the website and material on the website including the names, images and logos identifying Wastebuster. Subject to the licence below, all our intellectual property rights are reserved.3.2You may terminate this Agreement at any time by destroying all materials obtained from the Site and all related documentation and all copies and instalments thereof whether made under the terms of this Agreement or otherwise.3.3This Agreement will terminate immediately without notice from Wastebuster, if in Wastebuster's sole discretion you fail to comply with any term or provision of this Agreement.
- Licence to use website
4.1Wastebuster will grant licence to all Wastebuster online resources to member schools for the duration of their contract term and subject to the terms of service.4.2Wastebuster grants licence to view, download for caching purposes only, and print pages from the website, provided that:
4.3As a participating school, you may download/ print and copy all resources available on this site for educational purposes only (which for the avoidance of doubt does not include material on any linked website of a third party).
- no material from this website is republished (including republication on another website), or reproduce or store material from this website in any public or private electronic retrieval system;
- schools do not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit the website or material on the website for a commercial purpose, without our express written consent;
- school’s do not edit or otherwise modify any material on the website.
- in the event schools download software from the Site in accordance with terms and conditions the software including any files, images incorporated in or generated by the software and data accompanying the software (together, the "Software") are licensed to you by Wastebuster. Wastebuster does not transfer title to the Software to you. You own the medium on which the Software is recorded, but Wastebuster, or others retain full and complete title to the Software and all intellectual property rights therein. You may not redistribute, sell, decompile, reverse-engineer or disassemble the Software.

5.1Schools agree not to change the characteristics of the existing brand/ logo/derivatives that could weaken, dilute, or undermine the visual consistency of the brand as a whole. No strap lines may be used in conjunction with the brand/ logo/ derivatives unless supplied by or approved by Wastebuster CIC. The brand/logo/derivatives must not be added to, obstructed, distorted or resized in a way that would be damaging to the original design concept. All colours, fonts, textures shapes & materials used in the design of the Brand/logo/derivatives must not be customised or changed without the express consent of Wastebuster CIC. Prior consent and approval must be sought from Wastebuster CIC for any representation of the brand in any materials.

6.1The information on this website is provided as part of the Wastebuster education programme, and you acknowledge that it would be unreasonable to hold us liable in respect of this website and the information on this website.6.2Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we not commit to ensuring that the website remains available or that the material on this website is kept up-to-date. School’s who rely on this information do so at their own risk.6.3To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill).6.4Our liability is limited and excluded to the maximum extent permitted under applicable law. - Any warranty or condition implied by statute in the event of your dealing as a "consumer" as defined by section 12 of the unfair contract terms act 1977. In such a case your statutory rights are unaffected by these terms and conditions; or

- Restricted access
7.1Access to certain areas of the website is restricted. 8.3This Agreement will terminate immediately without notice from Wastebuster, if in Wastebuster's sole discretion you fail to comply with any term or provision of this Agreement.

- indemnify Wastebuster against all legal fees, damages and other expenses that may be incurred by Wastebuster as a result of your breach of the above warranty; and
- agree to waive any moral rights in your contribution for the purposes of its submission to and publication on this Site and the other purposes specified above; and
- acknowledge and agree that it may be copied or downloaded by users pursuant to clause 4.2.

15.1If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

16.1This notice will be governed by and construed in accordance with English law, and any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of England.
